Foreigners can only invest in the real estate properties located in certain areas of the city which are called freehold areas. In order to acquire the property in these areas foreigners need a valid foreign passport only. The buyer receives the full package of rights to the property acquired: ownership, sale, lease.
When the transaction is completed, the money is transferred to an escrow account, where it is kept there until the real estate is handed over to the client. The back account is opened at the conclusion of a tripartite agreement between the bank, the developer and the buyer. None of the parties can deal with the deposit: the bank blocks the money until the property is handed over to the buyer.
When acquiring the property in Dubai the buyer is to issue an Oqood certificate and pay the registration fee of 4 % of the value of the property to the Dubai Land Department.
Oqood is a certificate of a real estate ownership in the residential complexes under construction in Dubai. This very document is required in order to register all types of real estate and related to them agreements, concluded between buyers and developers. The cost of the certificate is 3000 AED or 800$.
When the residential complex is commissioned, the Oqood is changed to a Title Deed (certificate of ownership).
